Once known as an Architect’s Certificate, or a CML Certificate (Council of Mortgage Lenders), the current industry standard for newly built or converted properties is a No developer liability/defects period. It must be administered by a professional consultant, like an architect.

If you intend to get a mortgage to help you finance the property purchase, then you’ll need to prove that the construction work adheres to acceptable building standards. Before offering you a loan, mortgage lenders will normally require proof such as a PCC or 10 Year Structural Warranty.

All building work in England and Wales must comply with safety codes, including the Building Safety Act and Building Regulations. Anyone carrying out building work is obligated to notify their local Building Control office, and submit an application for legal approval.

Building Control inspection stages

After submitting a Building Control application and receiving approval to proceed with the work, you must organise a series of inspections at key stages of your planned build. During these regular Building Control inspections, a surveyor will check specific elements of the building work, making sure that it complies with the plans you provided and the relevant legislation.

Your Building Control inspector will discuss the statutory inspections and any additional checks you require in advance, but the typical stages for inspection include:

  • Commencement – Checking site conditions on the day that work begins.

  • Foundation excavation – Analysing ground conditions before concrete foundations are laid.

  • Oversite – Inspecting damp-proof membranes or sub-floors before they’re covered.

  • Drains – Checking materials, laying, and access points before backfilling.

  • Drainage tests – Testing the effectiveness of the drains once completed.

  • Floor joists – Inspecting the size, grade, and centring of floor and ceiling joists.

  • Roof timbers – Checking size, grade, bracing, and spacing of roof timbers.

  • Occupation – Notifying Building Control if anybody occupies the building before completion.

  • Completion – Full inspection of the entire structure within a week of building completion.

The final inspection will cover everything from thermal and sound insulation to safety glazing, ventilation and fire safety to staircases and waste systems. If everything is up to standard, the Building Regulations inspector can sign off on the work and issue a completion certificate.

If you have taken out a Structural Warranty on the build, then you’ll also need regular checks from your provider to help prevent latent structural defects. Though their scope is wider than structural issues, Building Control inspections can also help to identify poor quality work before such problems can develop – which is why using the same provider for both can be convenient.

PCC is a legal document confirming that your project has been completed satisfactorily, monitored by a professional and signed off by a qualified architect or surveyor.

It states that the construction work conforms to planning permissions, building regulations, and other associated contracts.

Since PCCs are often issued by architects, they are sometimes referred to as Architect’s Certificates. Before the UK Finance merger took over the Council of Mortgage Lenders, they were also called CML Certificates. However, the current appropriate name is the Professional Consultants Certificate.

It’s considered a more affordable alternative to a Structural Warranty, but it’s important to note that a PCC is not a latent defects insurance policy. A Professional Consultants Certificate provides limited legal cover for defect liabilities, but these certificates are necessary to secure mortgages.

If you need to take out a loan to fund construction of the property, then you’ll need a PCC before the lender will release the funds. This especially applies to stage payments, where the bank releases the money in instalments at key stages. Your PCC provider can supply interim certificates at each stage.

Even if you want a lump sum loan, you’ll still need legally valid proof that your purchase is covered against financial risks. The PCC ensures that the construction has been effectively monitored and properly completed, and that the consultant is liable if something goes wrong in the next 6 years.

Should you intend to sell the property on within 6 years, or rent it out with a Buy-to-Let mortgage instead of living in it yourself, you’ll still need a Professional Consultants Certificate. It offer lower costs initially, but you should upgrade to the more comprehensive Structural Warranty later on.
